1. Service

The firm provides legal advice and representation in Spanish immigration procedures, mainly online: assessment of the case, preparation of the file, electronic filing with the authorities, follow-up and, where needed, appeals.

2. Enquiries and first consultation

Sending an enquiry through the website is free and does not create a professional relationship. The first consultation with a lawyer costs €150 including VAT and is deducted from the rest of the fees if you instruct the firm on the matter.

3. Fees and letter of engagement

Before any work starts, the firm sends you a letter of engagement (hoja de encargo) setting out the service, the fees including VAT and what they cover. Government fees, sworn translations, apostilles, legalisations and other third-party costs are not included unless the letter says so. Accepting the letter electronically has the same effect as a handwritten signature (art. 23 Law 34/2002); the system keeps evidence of the acceptance (date, time and IP address).

4. Payment

By card through the secure payment gateway, or by the other methods indicated in the letter of engagement. Non-card payments are checked manually before work starts.

5. Right of withdrawal

If you are a consumer, you may withdraw from the contract within 14 calendar days from the day it is concluded, without giving a reason, by sending us an unequivocal statement (for example by email to info@peraltarojas.com). We will send you a model withdrawal form with the letter of engagement; using it is optional.

If you expressly ask us to start work during the withdrawal period and then withdraw, you will pay an amount proportionate to the services provided until you inform us of your withdrawal (art. 108.3 of the Spanish Consumer Protection Act). You lose the right of withdrawal only once the service has been fully performed, provided that you gave your prior express consent to performance starting during the withdrawal period and acknowledged that you would lose the right once the contract had been fully performed (art. 103.a). Filing the application does not by itself amount to full performance while other agreed services remain pending.

6. Your obligations

You agree to give true, complete and up-to-date information and to provide the documents requested within the time indicated. The outcome of a procedure depends on the authorities; the firm undertakes to act with professional diligence but cannot guarantee a particular result.

7. Governing law

Spanish law applies. Consumers may bring claims before the courts of their domicile.
